Abstract
In this chapter, we analyse the most significant cases on liability for market misstatements that were decided by Italian courts in the last twelve years, and we show how Italian courts cope with problems that are typical of this kind of liability around the world. In Section 2 we describe Italian Law on issuers’ and gatekeepers’ liability. In Section 3 we analyse the most significant cases and compare their approach with that followed by US Courts.
